WAIVER OF CLAIMS – RELEASE FROM LIABILITY – ASSUMPTION OF RISK – PHOTO/VIDEO RELEASE

YOU MUST BE 19 YEARS OF AGE TO AGREE TO THIS WAIVER

WARNING: BY SIGNING THIS WAIVER YOU ARE GIVING UP LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE

To: Online Pole Dance (the "Business")

1. This agreement witnesses that for good and valuable consideration, including the acceptance of the application of the undersigned for participation with Online Pole Dance, the sufficiency and receipt of which consideration are hereby acknowledged, the undersigned hereby agrees as follows:
                            

2. I, for myself, my heirs, executors or anyone else who may claim on my behalf, release and forever discharge, Online Pole Dance and their owners, operators, directors, officers, instructors, agents, party presenters, employees, contractors, executors, lessors, affiliates and representatives (collectively, the "Releasees") from any and all responsibilities or liability that they or any of them may have, for personal injury, death, property damage or other loss, sustained by me in connection with, or as a result of, my participation in any programs, classes, workshops or parties or my use of equipment belonging to or made available by Releasees due to any cause whatsoever, including without limitation to negligence of the Business or any of the Releasees.
                            

3. I hereby waive any and all claims I may now, previously, or have in the future against the Releasees, or any of them, and I agree not to sue the Releasees, or any of them.
                            

4. I acknowledge that there are certain risks involved in my participation with Online Pole Dance, in addition to the usual risks and dangers inherent in any physical activity, including without limitation slips, falls, physical contact with another person or equipment, abnormal blood pressure and heart rate, fainting, heart attack, wounds, bruises, muscle strain and soreness, sprains, broken bones, head injuries, back/neck injuries, hip/knee/foot injuries, hand/arm/shoulder injuries and malfunction of equipment or facilities.
                            

5. I acknowledge that the enjoyment and excitement that I receive from my participation at Online Pole Dance is derived in part from the risks inherent in participation at Online Pole Dance, and that those risks contribute to my enjoyment & excitement of participating at Online Pole Dance.
                            

6. I hereby assume and accept all of the dangers and risks connected with, or related in any way to, my participation at Online Pole Dance, and the possibility of personal injury, death, property damage or loss resulting from any of the foregoing.
                            

7. I hereby declare that I have had a physical examination and have been given my physicians permission to participate, or that I have decided to participate in activity and/or use equipment without the approval of my physician and do hereby assume all responsibility for my participation in activities and use of equipment in my activities. At the time of signing, I fully acknowledge that I am not pregnant and am aware of the risks of attending classes while pregnant.
                            

8. In entering into this Agreement, I confirm that I am not relying on any representation or statement made by the Business or any of the Releasees, whether oral or in writing, to induce me to participate at Online Pole Dance or minimizing the risks or dangers connected with or related to my participation with Online Pole Dance.

9. I agree that this Agreement may not be modified in any way and any attempted modification is not accepted by Online Pole Dance.
                            

10. I agree that this Agreement constitutes a legally binding obligation enforceable in accordance with its terms, and that it shall continue to bind me and my heirs, executors, legal representatives and personal assigns.
                             

11. This agreement shall be governed by the laws of the Province of British Columbia and the Law of Canada applicable therein and each of the parties hereby submits to the non-exclusive jurisdiction of the Province of British Columbia in connection with this Agreement. I further affirm that the venue for any legal proceedings shall be in the Province of British Columbia, Canada.

12. I agree not to divulge or appropriate for my own or to the use of others in competition with Online Pole Dance, any intellectual property which may or may not include dance routines, pole tricks, moves, instructional techniques, performances, design of website and materials, forms, class descriptions, secret or confidential information or knowledge pertaining to the business of Online Pole Dance, obtained by me in any way while I was in direct contact with Online Pole Dance.
                             

13. I understand that this waiver is intended to be as broad and inclusive as permitted by the laws of the Province of British Columbia, Canada and agree that if any portion is held invalid, the remainder of the waiver will continue in full legal force and effect.
                       

In addition, I understand and confirm that:

• Unauthorized distribution and reproduction of any and all materials provided by Online Pole Dance is strictly, with the exception of downloadable and printable materials provided to the students with expressed consent to do so.

• I use the knowledge acquired from Online Pole Dance and its staff at my own risk and that putting it into practice requires my own good judgment.

• All fees are non-refundable.

• Fees and memberships are non-transferrable - exceptions may be considered at the discretion of an OPD authority.
  

• Online Pole Dance & staff reserve the right to refuse service.
  

• Online Pole Dance & staff reserve the right to request my photo ID as proof of age requirements in order to sign this waiver.

• 
  Photography & Video Release Agreement
  I give my consent and permission to Online Pole Dance, and those acting on their behalf, to the use of any video, photographs, illustrations or other likeness of me taken or created by or on behalf of Online Pole Dance. All rights of these images and all related materials shall be owned by Online Pole Dance as part of an image bank intended to showcase the activities of Online Pole Dance for purposes including, but limited to, public display on their website, social media sites, promotional events, publications such as marketing and advertising products and the free distribution of these products.
                           

I agree that I shall have no claim against Online Pole Dance or against anyone accessing or using images as part of this collection.
                         

I understand that my video, photographs, illustrations or other likeness of me will not be sold to third parties.
                         

I agree that should I choose to have my video, photographs, illustrations or other likeness of me removed from Online Pole Dance’s image bank, that I (or my legal parent/guardian) shall be required to provide a written request.
                             
I confirm that I am 19 years of age, or have the permission from my parent or legal guardian (required to submit a copy of government issued ID), and that I have completely read this Agreement and that I fully understand the provisions of this Agreement. I understand that by signing this Agreement, I am giving up my legal rights including the right to sue.
